Abstract

Love, compassion and cooperation are pillars of the marital relationship originally based on, and its safeguard who protects it from which it may encounter in the midst of life .Long-lasting marriage is the slogan of Islam and its purpose given by its attention and interest.

As Islam has not ignored the existence of cases of disagreement between the spouses whom do not work with all Islam attention, it legislated laws to govern the separation of marriage as governed marriage before.

Islam embarked laws and rules that give the husband the right to terminate this relationship if he found that the relationship is not moving as desired in his wife of affection, compassion and cooperation .Provisions of divorce was an expression of the right of men to end this marital relationship in which it ensures the right of the wife as the husband who chose to end Wedlock.

At the same time, Islamic legislation didn’t lose sight of women's need for the initiative to end the marital relationship if found inability to continue the married life with her husband. As the man has the right to divorce, Islam gave women the right to the Khulu’ to get terminate un desired marriage , in which she fears not to maintain limits of God towards her husband .Islam legislated the rule of Khulu’ responding to this need for a wife.
